Terms of Service & End-User License
By creating an account or using the zukka application or this website (together, the "Service"), you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.
2. The Service — and its honest limits
zukka is a private messenger designed to keep no message history on your device and to store content on our servers only in encrypted form that we cannot read. We describe security mechanisms, not guaranteed outcomes: no software can promise absolute protection against every adversary. The Service is provided on an "as is" and "as available" basis; we do not warrant uninterrupted or error-free operation.
3. Your account and your keys
- You are responsible for your nickname, master password, PINs and encryption phrase.
- There is no recovery. If you lose your master password or encryption phrase, neither you nor we can decrypt your data. This is a deliberate property of the Service, not a defect.
- Features such as the panic password permanently destroy data when used. Their effects cannot be undone, by us or anyone.
4. Acceptable use
You may not use the Service to:
- violate any applicable law, or induce others to do so;
- store or share child sexual abuse material (CSAM) — zero tolerance; where we obtain actual knowledge of such material we will make reports required by law (including to NCMEC) and terminate the account;
- harass, threaten or defraud others, or operate spam at scale;
- probe, disrupt or overload the Service's infrastructure, or attempt to access other users' accounts or data;
- resell or commercially redistribute the Service without our written agreement.
Because content is encrypted, we cannot and do not monitor it. We act on abuse through signals that exist without reading content: in-app reports from users, account-level metadata anomalies, and valid legal process.
5. License
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the zukka application for its intended purpose. You may not copy (except as reasonably necessary), modify, distribute, sell, lease, or create derivative works of the application, and you may not reverse engineer it except to the extent a law expressly permits despite this term. zukka®, the zukka logo and related marks are property of Smartago LLC.
6. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access for breach of these Terms, for legal compliance, or to protect the Service and its users. Sections that by their nature survive (license restrictions, disclaimers, liability limits, governing law) survive termination.
7. Disclaimers and limitation of liability
To the maximum extent permitted by law: the Service is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Smartago LLC shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data that results from lost credentials or phrases, deliberate destruction features you trigger, or termination under these Terms — even if advised of the possibility of such damages. Where liability cannot be excluded, it is limited to the amount you paid for the Service in the twelve months before the claim (for a free service: zero, where the law allows).
8. Export and sanctions
The Service uses encryption and may be subject to export-control rules. You represent that you are not located in an embargoed jurisdiction and are not on a restricted-party list, and you agree to comply with applicable export and sanctions laws.
9. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles.
10. Changes
We may update these Terms; the current version always lives at this address with its date. Material changes will be highlighted in the app or on the site. Continued use after a change constitutes acceptance.
